Terms of service

Last updated 17 October 2026

These terms apply when a business ("you") uses ThSirius ("we", "us"), the cloud dialer at thsirius.com, including your workspace at yourcompany.thsirius.com. By creating a workspace or using it, you agree to these terms, to our Acceptable use policy and to our Privacy policy. If you accept them for a company, you confirm you may bind that company.

1. The service

ThSirius is software for running a contact centre: dialing, inbound calls, recording, compliance tools, reporting and the related features of your plan. Each workspace has its own signaling server and public IP address. ThSirius is for businesses only, not for personal or household use. We keep improving the service, and features may change; we will not remove a core feature of your plan without telling you first.

2. Your account and users

You decide who gets access to your workspace and with which role. You are responsible for everything done with your users' sign-ins, for keeping passwords and API keys safe, and for removing access when someone leaves. Tell us straight away if you think your workspace has been accessed without permission.

3. Calling laws are your responsibility

You decide whom you call, when, how and what is said. You must follow every law that applies to your calls and messages, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the National Do Not Call Registry rules, state telemarketing and call-recording laws, the Truth in Caller ID Act and, for calls to Canada, the CRTC's Unsolicited Telecommunications Rules. You are responsible for having the consent the law requires, for honouring opt-outs, and for using only caller ID numbers you are entitled to use.

ThSirius gives you tools that help, such as DNC scrubbing, calling-hour checks and consent records. They depend on the data and settings you provide and do not guarantee that your calls are lawful. They are not legal advice.

4. Carriers and telephone numbers

Calls go over the SIP carriers you choose and contract with. We are not a telephone carrier, and your carriers' rates, coverage, call quality and caller ID attestation are between you and them. ThSirius cannot be used to call emergency services: do not rely on it for 911 or any other emergency number.

5. Fees and payment

Prices are listed on our pricing page or in a quote we agree with you. A seat is one agent working at a time, and each month you pay for the highest number of agents working at once. Fees are charged from a prepaid balance that you top up by card. If your balance runs out, we warn you, and after a grace period your agents are paused until it is paid. Prices are in US dollars and do not include taxes, which you pay where they apply. We will give you at least 30 days' notice of a price increase.

6. Your data

Your leads, call recordings, transcripts and other data you put into ThSirius belong to you. You allow us to store and process them only to provide and support the service, as our Privacy policy describes. You can export your data at any time. You confirm you have the right to give us that data, including any notices or consents the law requires for recording calls. After your workspace is closed we delete its data within 90 days, except records the law requires us to keep.

7. Suspension

We may suspend a workspace, or stop particular calls or campaigns, if it breaks these terms or the Acceptable use policy, if fees are unpaid, if it puts the service, other customers or the public at risk, or if the law or a carrier or regulator requires it. Where we can, we will tell you first and give you a chance to fix the problem.

8. Availability

We work to keep ThSirius running and secure, but we do not promise it will be uninterrupted or error-free, and planned maintenance may briefly affect it. The service is provided "as is", without warranties beyond those the law does not allow us to exclude.

9. Liability

Neither side is liable to the other for indirect or consequential losses, such as lost profits or lost data that could have been exported. Our total liability for any claim about the service is limited to the fees you paid us in the 12 months before the claim. These limits do not apply where the law does not allow them.

You will cover us for claims, fines and costs that arise from your calls, your campaigns, your data or your breach of these terms, including claims under calling and telemarketing laws.

10. Ending the service

You can stop using ThSirius at any time. We can end the service with 30 days' notice, or sooner under section 7. Unused prepaid balance is not refunded, unless we end the service without cause or the law requires a refund.

11. Changes to these terms

We may update these terms. For significant changes we will tell workspace owners by email or in the app before they take effect. Continuing to use ThSirius afterwards means you accept the new terms.

12. Contact

Customers can open a ticket from Support in their workspace. Anyone else can reach us through our contact form.
